I. Terms and Conditions

1. General

In the period of 1st of September 2019 to 31st of January 2020 Henkel Central Eastern Europe Gesellschaft mbH (Division Schwarzkopf Professional), Erdbergstraße 29, 1030 Vienna, Austria (hereinafter “HENKEL”) together with the agency 79 Blue Elephants GmbH, Längenfeldgasse 27B, 1120 Vienna, Austria (hereinafter “AGENCY”, together with HENKEL the “ORGANIZERS”) are organizing the “OSIS Made to Create Competition” (Hereinafter referred to as the “COMPETITION”).

2. Eligibility to participate

Participants must be natural persons, of full age subject to local law and have been working in as a professional hairdresser for at least three (3) years (hereinafter “PARTICIPANT”).
A PARTICIPANT is understood to be one person, teamwork is not allowed. PARTICIPANTS do not need to have their own salon. In case they are employees in a salon, they must confirm that they have the consent of the salon’s owner regarding the participation in the COMPETITION. Each PARTICIPANT may only take part on his or her own behalf. In order to participate in the COMPETITION, all personal information supplied must be valid and true.
There is no limitation for participation in the number of hairdressers per salon. Participation is free of charge; each PARTICIPANT must prove the purchase of an OSIS starter package to HENKEL though by uploading an invoice.
Employees and agents of the ORGANIZERS are excluded from participation in the COMPETITION. Participation in the COMPETITION is only possible under the conditions stated. By participating in the COMPETITION, the PARTICIPANTS expressly recognize these Terms and Conditions.

3. Determination of Winners

HENKEL will conduct a contest between hairdressers from 13 countries in the Central Eastern European region (Belorussia, Bosnia & Herzegovina, Croatia, Czech Republic, Hungary, Latvia, Lithuania, Moldova, Poland, Russia, Slovakia, Slovenia, Ukraine). PARTICIPANTS shall upload photographs of hairstyles to the contest website.
The uploaded photos will be rated by a jury. HENKEL will select two (2) jurors per country. In total, there will be twenty-four (26) jurors. They will be well known hairdressers / stylists in the respective countries. Their names will be announced before the contest starts. Whilst rating the photos the jurors will not know the respective PARTICIPANTS’ names; the nominated jurors of the country will not vote for their country’s participants.

4. Course of the Competition

PARTICIPANTS must buy an OSIS starter package, register at the contest website and create a hair style with a model using OSIS products (“the WORK”). Three (3) photos of the model must be taken from different views and uploaded within one of the three categories. Together with these photos also one (1) “before-photo” from the model prior to the styling must be uploaded. Photos may be black & white, color or a mix of both.
To participate in different categories, different models and hairstyles must be used.
There are three (3) categories: “Color”, “Women” and “Avantgarde”.
All photos submitted except for “Avantgarde” must be commercial, wearable and reflect current trends. Professional photographers and makeup artists may be used. Photos do not have to show head and shoulders, but they do need to focus on the hair, especially in terms of lighting and pose. Photos should demonstrate trend driven and commercial styling with the emphasis on trend setting and innovation.
Photos for “Avantgarde” should demonstrate progressive styling with the emphasis on trend setting and innovation. “Avantgarde” entrants may use hairpieces for their hair styles. The “Avantgarde” category is understood as an “art category”.
Resolution of the photos must be ten (10) megapixels minimum, 300 dpi, file size 5 megabyte maximum. Photoshop editing is not allowed and disqualifies. Uploaded photos must be anonymous (no hints to hairdresser, salon, etc.); the hairstyle should be in focus.
Compliance with the aforementioned requirements is within responsibility of the PARTICIPANTS. Therefore, non-compliant photos will not be part of the contest. HENKEL has no obligation to advise PARTICIPANTS of any non-compliance, before disqualifying.
The contest website is www.osismadetocreate.com; in order to participate all data has to be filled in on this landing page, the Terms and Conditions and the Declaration of Consent have to be accepted and the photos have to be uploaded as described above until 31st of January 2020.

5. Prizes

Since there are three (3) categories per country, there will be max. three (3) winners per country. The country category winners will be sent to the regional contest in London at HENKEL’s or distributor´s expense. The winners will be announced publicly (on event or social media) latest 30th of June 2020. The regional contest is planned for October 2020 and will take place in London. If a country winner is not available at this time, she/he cannot be replaced by someone else. She/he will not be reimbursed for not being able to participate.
At the regional contest the final (regional) category winners will be determined by an international jury out of the country category winners. They will receive a trophy and an international training.

6. Liability and Transfer of Rights

By participating and uploading the photos (hereinafter referred to as “CONTRIBUTIONS”), the PARTICIPANTS confirm that they are the originators of the CONTRIBUTIONS, that they have all the rights to the uploaded CONTRIBUTIONS and that the CONTRIBUTIONS are free of third-party rights as well as not infringing any third-party rights. PARTICIPANTS can be held responsible, if CONTRIBUTIONS uploaded by them, violate applicable laws or third-party rights.
If persons other than the PARTICIPANTS are involved in the preparation or development of the CONTRIBUTIONS, the PARTICIPANTS must obtain their consent prior to submission and possible subsequent publication within the COMPETITION. The same applies in the event that a third party has been granted a right to the submitted CONTRIBUTIONS.
If persons are recognizable on submitted photos, the PARTICIPANTS must obtain their consent to the submission and subsequent publication prior to submission.
The PARTICIPANT grants HENKEL the exclusive, transferable (to affiliated companies and / or the respective local distributors of HENKEL), sub-licensable, royalty-free right, unlimited by time and location, to use, exploit and reproduce the photos in all media (e.g. social-, online- and print- media) for advertising purposes.
PARTICIPANTS agree to that by uploading the photos.
HENKEL does not accept responsibility for entries lost through technical fault. Proof of entry is not automatically proof of receipt. With the award of the prize, Henkel is free of all further obligations.
HENKEL shall only be liable for damages in connection with the performance of this COMPETITION if it was caused by HENKEL intentionally or by gross negligence.
HENKEL is not liable for damages caused by errors, delays or interruptions in the transfer, faults in the technical facilities and service, incorrect contents, loss or deletion of data, viruses or anything else that can arise in the participation of a competition.
There is no liability for the individuals excluded in accordance with Paragraph 8.

8. Violation of Conditions of Participation

HENKEL reserves the right to exclude the respective PARTICIPANTS from the COMPETITION in the event of a breach of the Terms and Conditions or for intentional or unintentional misrepresentations. PARTICIPANTS who use unauthorized tools or otherwise obtain an advantage through manipulation are also excluded. In such cases, HENKEL may even revoke and require the return of any prize.
The PARTICIPANT is further aware that HENKEL does not tolerate content that is unrelated to the COMPETITION and that offensive content which violates common decency will be deleted immediately. This includes content which is obscene, pornographic, threatening, inciting violence, discriminatory, racist, abusive, degrading, advertising, misleading, or unlawful, as well as content that violates third party rights (including copyright and personal rights) demeaning third parties, advertising for third parties or calling for acts of violence.

9. Termination

HENKEL reserves the right to cancel or terminate the COMPETITION at any time without notice. This applies in particular, but not exclusively, for cases in which for technical reasons – for instance infection of the system with virus, manipulation or errors in the hardware and / or software or for legal reasons – a proper execution of the COMPETITION is made difficult, influenced or impossible. In such case the PARTICIPANTS shall not have any claims against HENKEL. Termination caused by a PARTICIPANT entitles HENKEL to claim compensation.

10. Changes

HENKEL reserves the right to change or supplement these Terms and Conditions at any time without reasoning, as far as this is necessary in the interest of a simple and secure processing and in particular for the prevention of misuse or for other reasons.

11. Miscellaneous

A cash payment of the prizes is not possible. There is no right of appeal. These Terms and Conditions and the entire legal relationship between the PARTICIPANTS and HENKEL are governed by Austrian law. Should any provision of the Terms and Conditions be or become invalid, such invalidity shall not affect the validity of the Terms and Conditions as such. The Terms and Conditions may be changed by HENKEL at any time without separate notification.

II. Data protection agreement
for participation in the COMPETITION

In order to participate at the COMPETITION and to receive the prize, the PARTICIPANT(S) must supply the following personal data: name, email address, phone number, country, participating photos and text.
There is no right to registration.
HENKEL will gather and use the data provided by the PARTICIPANT(S) as part of the necessary process for providing the prize, conducting the COMPETITION and for inviting the PARTICIPANT to the next COMPETITION.
HENKEL will not forward the PARTICIPANT’S data to any third party unless for the distribution of prizes, for conducting the COMPETITION and for invitation of the PARTICIPANT to the next COMPETITION.
Name, email address, phone number, country, photos and text of the PARTICIPANT will be forwarded to the AGENCY in the name of HENKEL for the purpose of comparison and update of contact details. Contact data management by the AGENCY is part of the legitimate interest of HENKEL of outsourcing corporate processes.
The processing and use of the PARTICIPANT’S data are based on statutory provisions which justify those operations on the grounds that the processing is necessary for conducting the COMPETITION and providing the prize. The processing and use of the PARTICIPANT’S data is based on HENKEL’S legal interest to invite PARTICIPANTS to the next COMPETITION.
The personal data will only be used for the COMPETITION, for the supply of the prize and for invitation of the PARTICIPANT to the next COMPETITION. HENKEL will store the data 12 (twelve) months from the end of the COMPETITION on or as long as required in case any statutory retention obligation applies, legal claims may be enforced, or other legitimate interest justify storing the personal data.
Any further information concerning how HENKEL processes personal data may be found in the Data Protection Statement.
At any time, the PARTICIPANT may assert the right to access its data. Additionally, provided that the respective requirements are met, the PARTICIPANT may assert the following rights:

  • Right to rectification
  • Right to erasure
  • Right to restriction of processing
  • Right to lodge a complaint with the respectively competent data protection supervisory authority
  • Right to data portability

Right to object of PARTICIPANT
In case of processing activities involving your personal data that are carried out on basis of a legitimate interest of HENKEL, you have the right to object against such processing of your personal data at any time for reasons resulting from your specific situation. HENKEL will stop that processing unless HENKEL can prove important reasons for the processing which deserve protection which outweigh your interests, rights and freedoms or if the processing serves to assert, exercise or defend against legal claims.
